International Tax Service

Miller Rieke Whitsell & Co., PS provides services to executives on international work assignments, business owners, and high net worth individuals. We focus on the tax planning and compliance issues related to United States citizens and residents employed outside of the United States and foreign nationals employed within the United States. Chris Rieke manages the international tax services provided by Miller Rieke Whitsell & Co., PS.

The following is an outline of services that we provide and a list of references.

Why Are Expatriate Tax Services Necessary for US Citizens and Residents?
Unlike most countries, the United States continues to tax its citizens and residents (green card holders) on worldwide income even when they no longer reside within the United States. Since expatriate citizens and residents continue to be subject to United States income taxes and subject to taxation in their new country of residence, it is important for an expatriate's tax professional to understand the various tax provisions that help the expatriate avoid double taxation (i.e., the payment of taxes to two or more countries on the same income).

The United States tax laws provide certain exclusion (an $80,000 annual foreign earned income exclusion and a foreign housing exclusion) and allow foreign tax credits to reduce a United States taxpayer's exposure to double taxation. Where United States tax laws do not allow a citizen to avoid double taxation, a number of income tax treaties exist to ease the burden.

United States income tax laws include many tests and other unique provisions that generally required the use of a tax professional with expatriate experience to develop tax plans and to properly compile tax returns. With the increase in one's income, United States work days, and types of benefits received, the greater the need to understand and utilize the many tax laws and provisions available to expatriate citizens and residents.

Why Are Inpatriate Tax Services Necessary for Foreign Nationals?
When foreign nationals come to the United States (Inpatriate) there are a number of tax provisions that may cause the individual to become subject to taxation. One must evaluate the number of days the individual was present in the United States, the source of his/her income, special visa status, etc., to determine whether income is subject to United States taxation.

Special elections are available to foreign nationals that may help reduce any United State income tax obligation. Tax planning prior to a foreign national's arrival is important to determine the elections that may be available, recommendations on the timing of income recognition events.
